BAIL GRANTED

Holding

The Court granted regular bail to the petitioner.

Summary

The petitioner, an 18‑year‑old student named Gautam Kumar, was arrested in connection with a case registered under Section 96 of the B.N.S. and has been in custody since 11 September 2025. The victim’s statement indicated no allegation against the petitioner and described a consensual relationship with a co‑accused. The petitioner, having no prior criminal record, sought regular bail, arguing his young age, clean antecedent, and the completion of investigation. The State opposed the bail application. Considering these factors, the Court ordered the petitioner’s release on bail upon furnishing a bond of Rs. 20,000 with two sureties of equal amount.

Issues considered

  • Whether regular bail should be granted to the petitioner under Section 96 of the B.N.S. considering his age, lack of criminal antecedent, and the victim’s statement.
