Patna High Court

Parashuram KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

Petitioner Parashuram Kumar was arrested for alleged assault, kidnapping and related offences under sections 137(2), 96, 329(4), 351(2), 62 and 3(5) of the B.N.S. The prosecution alleged that he entered a house with an iron rod, assaulted a girl, threatened her brother and brandished a knife before being caught. The petitioner claimed innocence, stating the victim had earlier supported him in another case and that her statement under Section 183 indicated no quarrel. The State opposed bail, citing the seriousness of the offences and prior accusations of kidnapping. The court, after considering the submissions and the length of custody, ordered that the petitioner be released on regular bail upon furnishing a bail bond of Rs.10,000 with two sureties, and allowed the application.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the nature of the offences alleged under the B.N.S.
  • Whether prior allegations of kidnapping and the circumstances of the incident preclude the grant of bail
