Patna High Court

Sata Yadav @ Satyanarayan YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioners subject to specified conditions.

Summary

The petitioners, Sata Yadav and Sonu Yadav, sought anticipatory bail fearing arrest in a case (Rajoun PS Case No. 291 of 2020) involving offences under Sections 147, 149, 307, 341, 323, 504 and 506 of the IPC. They claimed they were falsely implicated due to a land dispute and asserted no criminal antecedent. The State opposed the bail, but the court noted the absence of any specific allegation that the petitioners assaulted the informant and that they were only alleged members of a gang. Considering their clean record, the court granted anticipatory bail under Section 438(2) of the CrPC and Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, subject to a bail bond of Rs.10,000 each, two sureties, cooperation with investigation, and verification of criminal antecedents. The order also provided for possible cancellation of bail if antecedents are concealed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 438 CrPC and Section 482(2) B.N.S. 2023
  • Whether the petitioners pose a risk of absconding, tampering with evidence or influencing witnesses
  • Whether the petitioners have any undisclosed criminal antecedents
