Patna High Court

Abhay KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the prima facie allegations against the petitioner are general and omnibus, warranting the grant of bail.

Summary

The petitioner, Abhay Kumar, was named in an FIR for offences under the Bhartiya Nyaya Sanhita relating to a rape‑murder case in which co‑accused Rajpal Mahto was the principal offender. The petitioner was alleged to have helped rescue Rajpal from the custody of the informant and villagers after the crime. The petitioner’s counsel argued that he has a clean antecedent and is merely a co‑villager caught up in village politics. The State opposed bail, but the court observed that the allegations against the petitioner were general and omnibus in nature. Consequently, the court ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to the conditions of Section 438(2) Cr.P.C. and Section 482(2) BNS.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences alleged under the BNS.
  • Whether the allegations against the petitioner constitute a specific charge or are general and omnibus, justifying bail.
