Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Shivakant Upadhya, was arrested in connection with a case registered under multiple sections of the Indian Penal Code, including assault, grievous hurt, and attempt to murder. The prosecution alleged that he assaulted an informant with a daab, causing injuries, and that other accused were also involved. The petitioner contended that he is innocent, has no prior criminal record, and that the injuries were simple, having been in judicial custody since 23 August 2025. The State opposed the grant of regular bail, citing the seriousness of the offences. After hearing both sides, the High Court considered the facts, the petitioner’s lack of antecedents, and the nature of the injuries, and decided to enlarge regular bail. Accordingly, the petitioner was ordered to be released on a bail bond of Rs.10,000 with two sureties, subject to the satisfaction of the Chief Judicial Magistrate.
