Patna High Court

Sanjay SinghversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The Court dismissed the petition for anticipatory bail, holding that the criteria for such relief were not met.

Summary

The petitioner, Sanjay Singh, sought anticipatory bail fearing arrest in connection with a criminal case (Mashrakh P.S. Case No. 322 of 2020) involving multiple offences under the Indian Penal Code. The prosecution alleged that the petitioner assaulted a victim, causing grievous injuries, and charged him under sections 147, 148, 149, 341, 323, 325, 307, 324, 447, 504, and 506 of the IPC. The petitioner argued that anticipatory bail was necessary to avoid unlawful detention, while the State opposed the relief. The Court examined the seriousness of the alleged offences and the risk of the petitioner absconding, and concluded that the criteria for anticipatory bail were not satisfied. Consequently, the Court dismissed the anticipatory bail application, directed the petitioner to surrender within four weeks, and warned that failure to do so would result in his arrest by the Superintendent of Police, Saran.
