The Court granted bail to the petitioner.

Summary

The petitioner, Sanni Shekhar Singh, was charged under Sections 80(2), 90(2) and 3(5) of the B.N.S. for the alleged murder of his pregnant wife, Chandani Kumari, who died along with her newborn. The prosecution alleged that the petitioner assaulted his wife after a financial dispute, leading to her death. The petitioner contended that he was falsely implicated and submitted medical records showing the deceased had severe anemia and that the post‑mortem report attributed death to natural lung disease with no antemortem injuries. He had been in judicial custody since 28‑12‑2024 and sought bail, which the State opposed. After hearing both sides, the Court found the medical evidence raised reasonable doubt and ordered the petitioner to be released on bail upon furnishing a Rs.10,000 bond with two sureties.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the allegations of murder and domestic violence.
  • Whether the medical and post‑mortem reports create sufficient doubt to negate a prima facie case against the petitioner.
