Patna High Court

Rakesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, finding that the circumstances justified release on bail.

Summary

The petitioner, Rakesh Kumar Ranjeet Mahto, applied for bail in a criminal case registered under Sections 103(1), 61(2), 351(2) and 352 of the B.N.S., alleging involvement in a murder that occurred on 30.05.2025. The prosecution alleged that the petitioner, along with other accused, intercepted the brother of an informant and murdered him. The petitioner contended that he was innocent, that the informant was not an eye‑witness, and that the case was based solely on circumstantial evidence; he also pointed to the fact that co‑accused had already been granted bail in a similar case. The State opposed the bail application, emphasizing the seriousness of the offences. Considering the nature of the accusations, the principle of parity with co‑accused, and the period of custody, the court allowed the bail, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties of equal amount.

Issues considered

  • What is the applicability of bail provisions to the petitioner given the seriousness of the offences under Sections 103(1), 61(2), 351(2) and 352 of the B.N.S.?
  • Whether the circumstantial evidence and lack of an eye‑witness justify granting bail?
  • Whether parity with co‑accused persons who have already been granted bail warrants the same relief for the petitioner?
