Saukat Ansari @ Saukat AliversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to bond and surety conditions.

Summary

The petitioner, Saukat Ansari, was arrested in connection with a case registered under multiple sections of the Bihar Negotiable Instruments (B.N.S.) Act and Section 27 of the Arms Act for allegedly firing at a deceased person. The petitioner claimed innocence, asserting that another individual, Kaushar Ansari, was the actual assailant, and highlighted his clean antecedent and custody since 15 September 2025. The prosecution opposed the bail application, citing the seriousness of the offences. The court, after considering the facts and the petitioner's undertaking to cooperate with the trial, granted regular bail on the condition of furnishing a bail bond of Rs. 10,000 with two sureties and compliance with trial attendance requirements. Non‑compliance would lead to cancellation of the bail.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the offences alleged under the B.N.S. Act and the Arms Act
  • Whether the petitioner poses a risk of fleeing, tampering with evidence, or influencing witnesses
