Patna High Court

Rajeshwar SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, given the petitioner’s lack of participation in the illegal digging and the nature of the allegations, anticipatory bail could be granted under Section 482(2) of the B.N.S.S.

Summary

Petitioner Rajeshwar Singh, owner of a tractor allegedly used in illegal digging of government land, feared arrest under Sections 303(2) and 317(2) of the B.N.S. The prosecution alleged that his tractor was used alongside a JCB owned by co‑accused Dhirendra Kumar Singh, acting on instructions of contractor Mukesh Kumar, who had a government tender. The petitioner contended he had no role in the digging and was merely the tractor owner. The State opposed the anticipatory bail application. Considering the facts, the court found the petitioner innocent of the alleged wrongdoing and, applying Section 482(2) of the B.N.S.S., allowed the anticipatory bail with a bail bond of Rs.10,000 and two sureties, subject to conditions.
