Patna High Court

Sintu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The application for regular bail was allowed.

Summary

The petitioner, Sintu Kumar, was arrested in connection with a case (Harpur PS Case No. 100/2024) alleging that he killed his wife for dowry, offences punishable under Sections 80 and 3(5) of the B.N.S. He pleaded innocence, contending that the deceased had committed suicide and that he had been falsely implicated. The petitioner, who has a clean antecedent and has been in custody since 30‑09‑2024, applied for regular bail, undertaking to cooperate with the investigation. The State opposed the bail on the ground of the seriousness of the alleged dowry‑death offence. The Court examined the lack of conclusive evidence, the petitioner’s clean record, and the possibility of imposing reasonable bail conditions. Accordingly, the Court allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties of the same amount.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the dowry‑death allegation
  • Whether the evidence on record justifies denial of bail
