Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner subject to the stipulated conditions.

Summary

Mukesh Kumar, who is in custody, applied for bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act where 22.5 litres of illicit liquor were seized from his joint family house. The petitioner claimed innocence, stating he had no connection with the seized liquor, but the prosecution highlighted his prior similar criminal antecedent and his custody since 30‑10‑2025. The petitioner offered to deposit Rs. 2,500 with the Advocate Association and the State opposed bail. The court, considering the circumstances, granted bail on a bond of Rs. 10,000 with two sureties and imposed specific conditions, including presence at trial and verification of antecedents. The order clarified that any observations made would not affect the trial, and the bail bond is to be accepted upon receipt of the deposit.

Issues considered

  • Whether the petitioner is entitled to bail despite the alleged offence under the Bihar Prohibition and Excise Act and his prior criminal antecedent.
  • Whether the conditions imposed by the court for bail are lawful and appropriate.
