Patna High Court

Satyam Yadav @ Satyam KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Satyam Yadav, was charged with murder under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act, based on an FIR alleging that he and other accused surrounded the informant's husband and shot him dead. The petitioner argued that the informant was not an eye‑witness, that the FIR does not specifically name him, and that the post‑mortem report showed only two gunshot injuries despite five persons being alleged to have fired. The State opposed bail, but the court noted that a co‑accused, Deep Narayan Yadav, had already been granted bail by a coordinate bench. Considering the lack of specific incriminating material against the petitioner and the period of custody since 28‑02‑2025, the court ordered his release on regular bail with a bond of Rs.10,000 and two sureties. The bail order was pronounced by Justice Prabhat Kumar Singh.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the murder and arms offences alleged against him.
