Vijay RamversusThe State of Bihar

Decided

BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to conditions under Section 482(2) of the BNS.

Summary

Vijay Ram sought anticipatory bail fearing arrest in a case registered under several sections of the Bharatiya Nagarik Suraksha Sanhita (BNS) for alleged assault and theft during a land measurement incident. The prosecution’s informant, Bhagwan Ram, claimed that co‑accused assaulted him and his family and that Abhishek Ram stole Rs. 2,500, while a generic allegation was made against Vijay Ram for snatching an earring worth Rs. 15,000. Vijay Ram asserted his innocence and clean antecedents, and the State’s Additional Public Prosecutor did not contest his claim. The court examined whether the allegations justified denial of bail and considered the provisions of Section 482(2) of the BNS. Concluding that the accusations were not sufficient to deny bail, the court granted anticipatory bail with a bond of Rs. 10,000 and two sureties, subject to conditions under Section 482(2).

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita in view of the alleged offences.
  • Whether the allegations against the petitioner constitute sufficient ground to deny anticipatory bail.
