Patna High Court

Bibi Kunti @ Kumni @ KumaniversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The court denied anticipatory bail, holding that the nature of the accusations does not merit such relief.

Summary

The petitioners, who are relatives of a missing woman, filed an anticipatory bail application fearing arrest in a case registered under Sections 498A and 365 of the Indian Penal Code alleging torture for dowry. The FIR alleges that the petitioners tortured the informant’s daughter, who is now missing. The petitioners sought protection from arrest, arguing lack of evidence. The court examined the seriousness of the allegations, especially the dowry‑related torture and the victim’s disappearance. Considering the nature and gravity of the accusations, the court rejected the prayer for anticipatory bail. Consequently, the petition was dismissed.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners accused under Sections 498A and 365 IPC given the nature of the allegations
  • Whether the seriousness of the dowry‑related torture and the victim’s disappearance warrants denial of anticipatory bail
