The Court granted anticipatory bail to the petitioner under Section 438 CrPC.

Summary

Manish Kumar Raja applied for anticipatory bail fearing arrest in a robbery case (Section 392 IPC) where a bank manager’s bag was allegedly snatched. The prosecution’s case is based on a confessional statement of co‑accused Vikash Kumar, which mentions the petitioner, though no material was recovered from him and he has no criminal record. The petitioner argued that he was falsely implicated and that a similarly situated co‑accused had been granted anticipatory bail in Cr. Misc. No. 82751 of 2024. The State opposed the bail. After hearing both sides, the Court granted anticipatory bail, directing the petitioner to surrender within four weeks and to furnish a bail bond of Rs 10,000 with two sureties, subject to the conditions of Section 438(2) CrPC.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC in view of the allegations and the confessional statement of a co‑accused.
