The court may extend the surrender period by four weeks, subject to a Rs. 500 payment to the Legal Services Committee.

Summary

Manu Singh, the petitioner, had been granted anticipatory bail by the Patna High Court in a case registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, and was directed to surrender before the lower court within four weeks. He filed an application seeking an extension of the surrender period and a modification of the earlier order. The court examined whether the statutory provisions and the bail order permitted such an extension and whether imposing a condition of payment to the Legal Services Committee was appropriate. Relying on the discretion vested in the court under the bail provisions, the judge held that an extension could be granted with a reasonable condition. Consequently, the surrender period was extended by an additional four weeks, subject to the petitioner paying Rs. 500 to the Patna High Court Legal Services Committee. The application was disposed of by granting the requested relief.

Issues considered

  • Whether the court may extend the time granted for surrendering after an anticipatory bail order
