BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to conditions, after finding insufficient material to justify denial.

Summary

The petitioner, Dharmendra Kumar, sought anticipatory bail in a case (Bela P.S. Case No. 113 of 2020) alleging kidnapping of a minor under IPC sections 365, 366, 366A and Section 4 of the POCSO Act. The prosecution alleged that the petitioner, along with co‑accused, abducted the informant’s daughter, but the victim’s statement under Section 164 of the Cr.P.C. did not name him and there were no eyewitnesses. The petitioner argued that he was falsely implicated due to personal enmity, highlighted a two‑day delay in filing the FIR, and pointed out his clean criminal record. The State and the informant opposed the bail, but the court noted the absence of the petitioner’s name in the victim’s statement, the grant of anticipatory bail to another co‑accused, and the conviction of the main accused. Considering these factors, the court granted anticipatory bail with a bond of Rs.10,000 and two sureties, subject to cooperation with investigation and verification of any concealed criminal antecedent.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the allegations under IPC and the POCSO Act.
