BAIL GRANTED

Holding

Anticipatory bail was granted, subject to a bail bond of Rs.10,000 and two sureties, and the condition that the petitioner surrender within eight weeks if arrested.

Summary

The petitioner, Sanjeev Kumar, sought anticipatory bail fearing arrest in a case registered under several sections of the Bhartiya Nyaya Sanhita for allegedly assaulting the informant's father with a stick, causing a simple injury. The petitioner asserted a clean antecedent. The State opposed the bail application. The court, considering the minor nature of the injury and the petitioner's clean record, ordered that if the petitioner is arrested or surrenders within eight weeks, he may be released on bail upon furnishing a bail bond of Rs.10,000 with two sureties of the same amount, subject to conditions under Section 482 of the B.N.S.S. 2023. The order effectively granted anticipatory bail with specified conditions.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482 of the Bhartiya Nyaya Sanhita in view of the alleged offences and his clean antecedent.
