The Court granted regular bail to the petitioner on the condition of a bail bond and sureties.

Summary

The petitioner, Bhajo Paswan, sought regular bail in a case registered as Asthawan P.S. Case No. 95 of 2025, which alleged offences under Sections 80, 238(a) and 61(2) of the B.N.S. The prosecution alleged that the deceased Soni Kumari was subjected to dowry cruelty and was killed by her in‑laws, who then concealed her body. The petitioner, the deceased's brother‑in‑law, contended that he was innocent, had no involvement in the alleged murder, and that the primary accusation was against the husband, who is already in custody. He had been in judicial custody since 12‑08‑2025. After hearing both sides, the Court found no sufficient ground to deny bail and ordered the petitioner to be released on a bail bond of Rs.10,000 with two sureties, subject to the satisfaction of the Judicial Magistrate.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the dowry‑related murder allegations
