The application for bail was dismissed, and the petitioner was directed to surrender and apply for regular bail.

Summary

Satendra Turha applied to the Patna High Court seeking regular bail after his name appeared in the driver’s self‑inculpatory statement in a case involving the seizure of 470.083 kg of ganja. The prosecution alleged that the seized narcotics were linked to the petitioner under Sections 20(b)(ii)(c), 25 and 29 of the NDPS Act. The court examined the material on record, noted the seriousness of the offence and the large quantity of drugs involved, and found no sufficient ground to grant bail. Consequently, the application was dismissed and the petitioner was ordered to surrender within two weeks and apply for regular bail thereafter. The Superintendent of Police was directed to take steps for the petitioner’s arrest.

Issues considered

  • Whether the petitioner is entitled to regular bail in a case under Sections 20(b)(ii)(c), 25 and 29 of the NDPS Act involving a large quantity of narcotics.
