Holding

The court granted regular bail to the petitioner with specified conditions.

Summary

The petitioner, Md. Jamshed, was arrested in connection with a theft case under Sections 305 and 331(4) of the Bihar Negotiable Instruments Act, alleged to involve the stealing of valuables worth Rs.50,000 and cash of Rs.10,000. He had been in judicial custody since 18 July 2025 and had given a confessional statement, though the recovered coins were not the subject of the charge. The prosecution opposed bail, highlighting the petitioner’s criminal antecedent of fourteen pending cases. The petitioner’s counsel argued that apart from the confessional statement there was no other incriminating material against him. After hearing both sides, the court granted regular bail on the condition of cooperation with the trial, regular attendance, and a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail should be granted to the petitioner under Sections 305 and 331(4) of the Bihar Negotiable Instruments Act despite his confessional statement and prior criminal antecedents.
