Patna High Court

Vinay Pal @ Binay PalversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner.

Summary

Vinay Pal was arrested in connection with a kidnapping and murder case (Sections 364 and 302 IPC) arising from an incident on 26 May 2022, with the FIR lodged 45 days later. The petitioner, claiming a clean antecedent, argued that the investigation was complete, a charge sheet had been filed, and no incriminating material was found against him. He also highlighted that co‑accused in the same case had previously been granted anticipatory or regular bail. The State opposed bail, citing the seriousness of the offences. The court, noting the delayed FIR, the completed investigation, the petitioner’s clean record, and the precedent of bail to co‑accused, ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to Section 480(3) of the BNSS.

Issues considered

  • Whether bail should be granted in a case involving kidnapping for ransom and murder under Sections 364 and 302 IPC.
  • Whether the delay in lodging the FIR and the completion of investigation without incriminating material justify bail.
  • Whether the petitioner’s clean antecedent and the bail granted to co‑accused warrant release on bail.
