Holding

The court granted regular bail to the petitioner.

Summary

Ayush Kumar was arrested in connection with a murder case (PS Ram Krishna Nagar Case No. 420 of 2025) alleged under Sections 103(1), 61(2), 325 read with 3(5) of the Bihar Negotiable Substances Act and Section 27 of the Arms Act. The FIR does not name him, but a co‑accused’s confessional statement mentions other persons firing at the victim, with no specific allegation against Ayush. He has been in judicial custody since 2 August 2025 and sought regular bail. The State opposed bail, but the court, after considering the lack of direct incriminating material against him, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties. The order was pronounced by Justice Ashok Kumar Pandey.

Issues considered

  • Whether bail should be granted to the petitioner when his name is absent from the FIR and no specific role is attributed to him in the co‑accused’s confessional statement.
