Decided

BAIL GRANTED

Holding

The petitioner is entitled to bail upon furnishing a Rs.10,000 bond with two sureties.

Summary

The petitioner, Sahid Ansari, applied for regular bail in a case involving alleged kidnapping, assault, and offences under the Bharatiya Nyay Sanhita and the POCSO Act. The prosecution alleged that the petitioner, with co‑accused, lured a school‑going girl, attempted to give her medicine, teased her, and pushed her into water, though the victim was rescued. The petitioner claimed innocence, citing lack of sexual assault in the victim’s statement recorded under Section 183 of the B.N.S.S., refusal for medical examination, and a clean criminal record, while noting that a co‑accused had already been granted bail. The State opposed bail, arguing seriousness of the offences. The Court, after considering the submissions and circumstances, ordered bail on the condition of a Rs.10,000 bond with two sureties, thereby allowing the application.

Issues considered

  • Whether the petitioner is entitled to regular bail for offences under Sections 74, 75, 3(5) of the Bharatiya Nyay Sanhita and Sections 4, 8 of the POCSO Act
  • Whether the victim’s statement and refusal of medical examination affect the bail decision
  • Whether the grant of bail to a co‑accused influences the petitioner’s bail application

counsel for the informant. Learned APP for the State is present

                   through virtual mode.

                                2. The petitioner has preferred this application for

coming on bike pulled her out of water and dropped her home.

                       4. Learned counsel for the petitioner has submitted

that the petitioner is innocent and has falsely been implicated in

this case due to some ulterior motive and village politics. The

statement of the victim was recorded under Section 183 of the

B.N.S.S. in which she did not state anything about sexual

assault and apart from that it has come in paragraph no. 42 of

the case diary that the victim has refused for her medical

examination. Moreover, similarly situated co-accused person,

namely, Asgar Ali has already been granted the privilege of bail

by a co-ordinate Bench of this Court vide order dated

been submitted that the petitioner has clean criminal antecedent

and is in custody since 01.11.2025.

                       5. Learned APP for the State has vehemently opposed

the prayer for bail of the petitioner.

                       6. Considering the aforesaid submissions of the

parties and taking into account the facts and circumstance of the
