Patna High Court

Johan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioners with specified conditions.

Summary

Petitioners Johan Kumar and Vikash Kumar were arrested on 26‑10‑2025 in connection with Agiaon (G) P.S. Case No. 209 of 2024, FIR dated 10‑12‑2024 for offences under Section 303(2) of the Bihar Narcotic Substances Act, 2023. They sought bail, claiming they were falsely implicated and that the motorcycle alleged to be stolen was recovered in a separate case (Udwantnagar P.S. Case No. 53 of 2025) where petitioner 1 already obtained bail under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. The State opposed bail, contending the motorcycle was found in the petitioners’ possession and noting their other pending criminal cases. The Court examined the facts, the existence of bail in the other case, and the petitioners’ criminal antecedents, and decided to release them on bail subject to a cash bond of Rs 10,000 each, two sureties, and conditions regarding cooperation, non‑tampering with evidence, and verification of antecedents. The order directed that acceptance of bail not be delayed for verification purposes.

Issues considered

  • What is the appropriateness of granting bail to the petitioners under Section 303(2) of the Bihar Narcotic Substances Act, 2023 given the existence of other pending cases and the alleged recovery of the stolen motorcycle?
  • Does the prior bail granted in Udwantnagar P.S. Case No. 53 of 2025 affect the bail application in the present case?
