Patna High Court

Vikash Kumar Suman @ Vikash KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner, finding that his clean antecedent and the completed investigation warranted release on bail.

Summary

Vikash Kumar Suman was arrested in connection with a case registered under sections 25(1‑B)(a), 26 and 35 of the Arms Act for the alleged recovery of 19 cartridges from the roof of an abandoned house adjacent to his residence. He pleaded that the cartridges were not in his possession, he has no prior criminal record, and he has been in custody since 20‑Oct‑2025. The State opposed his regular bail application. The court examined the petitioner’s clean antecedent, the fact that the investigation was complete, and the circumstances of the alleged recovery. Finding no compelling reason to keep him detained, the court ordered his release on bail upon furnishing a bond of Rs.20,000 with two sureties of the same amount. The bail was granted, and the petitioner was released.

Issues considered

  • Whether the petitioner is entitled to regular bail in a case under the Arms Act despite the seriousness of the alleged offence
