Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner.

Summary

Ranjan Kumar was arrested in connection with a Special POCSO case (No. 53 of 2022) for alleged abduction of a minor girl, charged under Sections 366(a), 504, 506, 34 of the Indian Penal Code and Section 8 of the POCSO Act. He had been in custody since 19 August 2025. The petitioner’s counsel argued that the girl had voluntarily eloped with him and that the petitioner was innocent. The court examined the seriousness of the offences and the circumstances of the alleged elopement. Finding no compelling reason to deny bail, the court allowed the bail application, directing release on a bond of Rs 10,000 with two sureties. The petitioner was ordered to appear before the lower court as required.

Issues considered

  • Whether bail can be granted to an accused in a POCSO case involving offences under Sections 366(a), 504, 506, 34 of the IPC and Section 8 of the POCSO Act despite the seriousness of the charges.
