Disposal
DISMISSED

Holding

The court denied bail, dismissing the petitioner's application.

Summary

The petitioner, Manish Rajak, applied for regular bail in a murder case (Rangra P.S. Case No. 188 of 2025) where he is accused, along with co‑accused, of killing Chhotu Razak under Sections 103(1) and 3(5) of the B.N.S. He has been in custody since 9 August 2025 and claims innocence, alleging false implication. The State and the informant opposed bail, asserting his participation in the killing. The court considered the heinous nature of the offence and the role attributed to the petitioner, and consequently refused to grant bail. The application was dismissed, with a direction that the petitioner may seek bail again if the prosecution causes trial delays. The order was pronounced by Justice Sandeep Kumar of the Patna High Court.

Issues considered

  • Whether regular bail should be granted to the petitioner accused of murder under Sections 103(1) and 3(5) of the B.N.S.
