Patna High Court

RajkumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail must be granted as there is no statutory embargo and the prosecution has failed to comply with the procedural requirements.

Summary

Petitioner Rajkumar was arrested on 19-08-2025 for alleged possession of 8 kg of ganja, alleged under Sections 8 and 20(b)(ii)(B) of the NDPS Act, 1985. He applied for bail, contending that he has a clean antecedent, the seized quantity is below the commercial threshold, and that the prosecution failed to comply with Section 50 of the NDPS Act and Sections 103 and 105 of the Bihar Narcotic Substances (Control) Act, 2023. The State opposed the bail on the ground of the seriousness of the offence. The Court examined the statutory provisions, noted the non‑compliance and the sub‑commercial quantity, and held that there is no embargo under Section 37 of the NDPS Act to deny bail. Accordingly, the Court granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding cooperation, presence in court, and non‑tampering with evidence. The order also directed that verification of the petitioner’s antecedent should not delay the acceptance of the bail bond.

Issues considered

  • Whether bail can be granted in an NDPS case where the seized narcotic quantity is less than commercial quantity and Section 50 of the NDPS Act has not been complied with
  • Whether non‑compliance with Sections 103 and 105 of the BNSS, 2023 bars the grant of bail
