BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner under Section 438(2) of the Cr.P.C., subject to stringent conditions.

Summary

The petitioner, Chandan Kumar, sought anticipatory bail in a case where he was accused of molestation, assault and other offences under sections 126(2), 115(2), 303(2), 74, 78 and 3(5) of the BNS, based on an FIR lodged by Madhubala Singh. The prosecution alleged that the petitioner, while intoxicated, touched the complainant inappropriately and assaulted her family members. The petitioner argued that the alleged touching was accidental, he has no prior criminal record, and a prior modification order clarified that earlier antecedent information pertained to another person. The court, considering his youth, lack of antecedents and willingness to cooperate, granted anticipatory bail under Section 438(2) of the Cr.P.C. with specific conditions, including library service, regular police attendance, and a bail bond of Rs.10,000 with two sureties. The order also directed the petitioner to file a supplementary affidavit by 30‑01‑2026 and scheduled a further hearing on 06‑02‑2026.

the BNS lodged on 27.07.2025 by the informant, Madhubala

                   Singh.

                                3. As per the prosecution story, the informant, a

          against this petitioner.

                       5. The last submission, on instruction, is that he shall

          is granted to him.

                       6. Learned APP opposes the prayer submitting that he

tried to outrage the modesty of a lady and upon protest,

alongwith other co-accused, assaulted the family members.

                       7. Taking into account the submissions of the parties
