Patna High Court

Chandan Raut @ Chandan MestarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed regular bail to the petitioner.

Summary

Chandan Raut was arrested in connection with a case registered under Sections 302, 201, 120B and 34 of the Indian Penal Code, alleging his involvement in a murder. He contended that the deceased died in a train accident and that he was falsely implicated, having been in custody since 8 July 2024. The trial had not yet concluded, and a lower court had denied his bail application on 21 November 2025. The petitioner’s counsel argued his innocence and the undue length of pre‑trial detention, while the State opposed bail. Considering the stage of the trial, the nature of the allegations, and the prolonged custody, the High Court allowed regular bail, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the accused in a case involving Sections 302, 201, 120B and 34 of the IPC given the stage of trial and period of pre‑trial detention.
