BAIL REJECTED

Holding

The anticipatory bail application was rejected.

Summary

Hare Ram Singh applied for anticipatory bail after being implicated in a case under Sections 25(1‑B)(a), 25(1)(a), 25(1)(b), 26 and 35 of the Arms Act, based on a raid that uncovered materials for manufacturing arms. The informant, Mukesh Kumar, alleged that during the raid a person tried to escape and, after being detained, identified the petitioner as an accomplice; the only link to the petitioner was a confessional statement of Gautam Kumar. The petitioner contended that no arms were found in his possession and that he had previously been acquitted in a separate IPC‑307 murder‑attempt case. The State highlighted the seriousness of the alleged gun factory discovered in Patna and the prior accusations against the petitioner. After weighing the submissions, the Court held that the seriousness of the allegations warranted denial of bail. Consequently, the anticipatory bail application was rejected.
