BAIL GRANTED

Holding

The Court allowed the petitioner's application for regular bail.

Summary

The petitioner, Devraj Kumar, was arrested in connection with a case registered under Sections 118(1), 118(2), 109(1), 351(1), 3(5) of the Bihar Negotiable Instruments Act and Section 27 of the Arms Act, alleged to have fired upon a victim and caused injury. The petitioner pleaded that he is an exceptional student with a clean antecedent and that he has been falsely implicated, submitting educational documents to support his claim. He had been in custody since 29 May 2025 and undertook to cooperate with the investigation. The State opposed the bail application, but the Court, after considering the petitioner’s documents and the period of custody, granted regular bail. The bail was set at a bond of Rs. 10,000 with two sureties of the same amount, subject to the satisfaction of the concerned court.

Issues considered

  • Whether bail should be granted to the petitioner despite the seriousness of the offences alleged under the Bihar Negotiable Instruments Act and the Arms Act
