Sintu Kumar @ Akshay KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to the conditions imposed.

Summary

The petitioner, Sintu Kumar, sought anticipatory bail in a case where he was alleged to have participated in assault and theft, with offences under IPC sections 147, 149, 341, 323, 307 and 379. He claimed innocence, arguing that the allegations were vague, the injuries to the victims were minor, and he had a clean antecedent. The State opposed the bail application. The Court, considering the nature of the accusations, the minor injuries, and the petitioner's clean record, granted anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and compliance with Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The order directed that if arrested within eight weeks, the petitioner be released on bail under the stipulated conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner given the alleged offences and circumstances.
  • Whether the allegations and nature of injuries justify denial of bail.
