Patna High Court

Sonu Kumar @ Sonu RajversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner on the condition of a bail bond and sureties.

Summary

Sonu Kumar was arrested in connection with a kidnapping allegation involving a 16‑year‑old girl, under sections 140(3) and 96 of the Bharatiya Nyay Sanhita, 2023 and section 12 of the POCSO Act. The informant claimed the girl was taken by the petitioner, but the girl’s statement recorded under section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023 did not support the prosecution. The petitioner, who has no prior criminal record, had been in custody for six months and a chargesheet had been filed. The State opposed bail, citing the seriousness of the offence and the driver’s testimony linking the petitioner to the crime. The Court, after considering the victim’s non‑supportive statement, the petitioner’s clean record and the length of custody, ordered regular bail on a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail should be granted to the accused under sections 140(3) and 96 of the Bharatiya Nyay Sanhita and section 12 of the POCSO Act despite the kidnapping allegation.
  • Whether the victim’s statement under section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023, which does not support the prosecution, affects the bail decision.
  • Whether the petitioner’s lack of criminal antecedent and the six‑month pre‑trial detention justify bail.
