BAIL GRANTED

Holding

Since no specific overt act is alleged against the petitioners and the female petitioners are unlikely to be culpable, the court granted anticipatory bail under Section 438(2) of the CrPC.

Summary

The petitioners – four residents of Vidyachak village – were named in an FIR (Imamganj PS Case No. 97 of 2018) for alleged assault with iron rods and other weapons, invoking IPC sections 341, 323, 337, 447, 307, 504, 506 and 34. They applied for anticipatory bail, contending that no specific overt act was alleged against them, especially the three female petitioners, and that the investigation was still pending. The prosecution could not point to any distinct act by the petitioners. The Court, noting the absence of specific allegations and the presence of women among the accused, decided to grant anticipatory bail. The bail was conditioned on a bond of Rs.10,000 with two sureties and compliance with Section 438(2) of the CrPC and Section 482(2) of the BNSS, 2023. The application was allowed, and the petitioners were directed to surrender within four weeks for bail execution.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners when no specific overt act is alleged against them.
  • Whether the presence of female petitioners warrants special consideration in granting bail.
