Patna High Court

Mantosh Singh @ Jhingu Singh @ Jhigur Singh @ Jhingur Singh @ Santosh SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that regular bail must be granted to the petitioner.

Summary

The petitioner, Mantosh Singh (also known as Jhingu Singh, Jhigur Singh, Jhingur Singh, Santosh Singh), was charged in Rivilganj Police Station Case No. 280 of 2020 for offences under IPC sections 341, 323, 324, 307 and 504/34. He was alleged to have, together with co‑accused Aniket Singh, stabbed an informant, causing severe injuries, and has been in custody since 17 November 2025. The petitioner filed a regular bail application, contending that the allegations were general and omnibus, that there was no specific overt act attributed to him, and that he possessed a clean antecedent. The State opposed the bail, arguing the seriousness of the charges. The Court examined the nature of the accusation, the petitioner’s clean record, the period of custody, and noted that the co‑accused had already been granted anticipatory bail. Finding no substantive justification to keep the petitioner detained, the Court ordered his release on regular bail upon furnishing a bond of Rs 10,000 with two sureties. The order was directed to the Judicial Magistrate, 1st Class, Saran at Chapra.

Issues considered

  • Whether regular bail should be granted to the petitioner despite the serious nature of the offences alleged
  • Whether the general and omnibus nature of the allegations precludes denial of bail
