Anticipatory bail was not granted as the case was not fit for such relief given the seriousness of the offences.

Summary

Manish Paswan applied for anticipatory bail fearing arrest in a case (PS No.67/2025) involving multiple offences under the Bharatiya Nyaya Sanhita, 2023, including assault causing grievous injury. The prosecution alleged that he had assaulted the victim, and the offences were serious in nature. The Patna High Court examined whether the gravity of the charges warranted the grant of anticipatory bail. Finding that the nature and seriousness of the offences made the case unsuitable for anticipatory bail, the Court rejected the application. The petitioner was ordered to surrender within two weeks and seek regular bail, with a warning that police would arrest him if he failed to comply. The Court clarified that its observations were limited to this application and would not prejudice later stages of the proceedings.
