Patna High Court

Chandan PatelversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

Chandan Patel was arrested on 29 October 2025 in connection with an assault case (PS Maharajganj Case No. 516 of 2025) involving alleged knife attacks on the brother of an informant, resulting in grievous injuries. The petitioner sought bail, claiming he was falsely implicated due to a petty dispute and that there was no intention to kill. The prosecution opposed bail, highlighting the seriousness of the offences under the Bharatiya Nyay Sanhita, 2023, the grievous nature of the injury, and the petitioner's prior criminal antecedent. The court examined the facts, the nature of the charges, and the bail application provisions. It granted bail on a Rs.10,000 bond with two sureties, imposing conditions of cooperation, appearance, non‑tampering with evidence, and verification of criminal antecedents.

Issues considered

  • Whether bail should be granted to the petitioner despite the seriousness of the offences under the Bharatiya Nyay Sanhita, 2023.
  • Whether the petitioner's prior criminal antecedent and the alleged grievous injury preclude bail.
  • Whether the conditions imposed are sufficient to ensure the petitioner's cooperation with the trial.
