The Court granted bail to the petitioner subject to a bond and specified conditions.
Summary
Gajadhar Mandal was arrested on 20 September 2025 in connection with a case alleging Naxal‑related offences under Sections 308(3), 308(4), 308(5), 61(2) of the Bharatiya Nyay Sanhita, 2023 and Sections 16, 17, 18, 20 and 21 of the Unlawful Activities (Prevention) Act. The prosecution relied on secret information, a black flag, pamphlets and a self‑confessional statement recorded in the case diary, while the petitioner claimed he was falsely implicated, had a clean antecedent and no material was recovered from his possession. The petitioner’s co‑accused, Govind Mandal, had already been granted regular bail. The Additional Public Prosecutor opposed bail, citing the petitioner’s confession. The Court, after considering the clean antecedent, lack of seized property and the precedent of bail to the co‑accused, ordered the release of the petitioner on a bail bond of Rs 10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence and verification of antecedents.
Issues considered
- Whether the petitioner is entitled to bail despite a recorded confession and the seriousness of the offences under the Bharatiya Nyay Sanhita and the Unlawful Activities (Prevention) Act
- Whether the absence of seized material and the grant of bail to a co‑accused justify granting bail to the petitioner
