Holding
A second anticipatory bail application lacking fresh material is not maintainable and must be dismissed.
Summary
The petitioner, Abhishek Kumar, filed a second anticipatory bail application before the Patna High Court after an earlier application was rejected on merit on 22 September 2025. The petition sought relief despite the absence of any new facts or circumstances that could justify reconsideration. The court observed that the application did not disclose any fresh material and cited the Supreme Court’s decision in G.R. Ananda Babu v. State of Tamil Nadu (2021 SCC OnLine SC 176) which holds that a second anticipatory bail petition without new facts is not maintainable. Consequently, the court dismissed the petition. The order reaffirmed the principle that anticipatory bail applications must be grounded in fresh evidence or changed circumstances.
