Patna High Court

Praveen Khatoon @ Parveen KhatoonversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Anticipatory bail was denied because the nature and gravity of the offences did not merit the privilege.

Summary

The petitioner, Praveen Khatoon, applied for anticipatory bail fearing arrest in a case registered under Sections 406, 420, 120B and 34 of the Indian Penal Code for allegedly cheating the informant of Rs. 25,90,000 by promising overseas employment. The prosecution alleged that both the petitioner and her husband were involved in the fraud. The High Court examined whether the seriousness of the offences and the risk of tampering with evidence justified granting anticipatory bail. Considering the gravity of the alleged offences, the Court held that the petitioner was not entitled to the privilege of anticipatory bail. Consequently, the application was rejected and the petitioner was directed to surrender within two weeks and seek regular bail. The order was limited to the present application and does not prejudice any future proceedings.
