BAIL GRANTED

Holding

Bail was granted to the petitioner with specified conditions.

Summary

Kumar Jee Kumar was arrested on 30 September 2025 in connection with a case involving alleged offences under Sections 310(4), 310(5), 303(2) and 3(5) of the BNS, 2023 and Sections 25(1‑Ba), 26 and 35 of the Arms Act. The police, acting on secret information, conducted a raid and recovered a country‑made pistol, three live cartridges and a mobile phone from his possession. The petitioner pleaded innocence, arguing that the FIR was fabricated and pointing out that co‑accused persons had already been granted bail by the same court. The prosecution opposed bail, citing two prior criminal antecedents of the petitioner. The High Court, noting the bail granted to similarly situated co‑accused and considering the circumstances, ordered the petitioner’s release on bail with a bond of Rs 10,000 and two sureties, subject to conditions regarding trial cooperation, non‑tampering with evidence, and verification of antecedents. The bail order was issued without delay for verification purposes.

Issues considered

  • Whether bail should be granted to the petitioner despite the seriousness of the offences and his prior criminal antecedents
  • Whether the grant of bail to co‑accused persons on similar charges mandates similar relief for the petitioner
