Shubham Kumar @ Shubham SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner.

Summary

Shubham Kumar, also known as Shubham Singh, applied for anticipatory bail fearing arrest in a kidnapping case (Shivsagar P.S. Case No. 260 of 2025) under Sections 137(2) and 140(3) of the B.N.S. The prosecution alleged that he had kidnapped the victim, while the petitioner asserted his innocence, citing a victim statement under Section 183 B.N.S.S. that did not implicate him and highlighting his clean antecedents. The State opposed the bail application. The court examined the merits of the anticipatory bail petition under Section 438(2) of the Code of Criminal Procedure, 1973 and Section 482 of the B.N.S. The judge found no sufficient ground to deny bail and consequently allowed the application. The petitioner was ordered to furnish a bail bond of Rs. 10,000 with two sureties, subject to the conditions prescribed in the relevant statutes.
