BAIL GRANTED

Holding

The court allowed the anticipatory bail application, directing release upon bail bond and sureties.

Summary

The petitioners, Madhavi Kumari and Aman Kumar, sought anticipatory bail fearing arrest in Teghra P.S. Case No. 50 of 2025, which alleged offences under several sections of the B.N.S. The prosecution alleged they assaulted an informant's husband, while the petitioners claimed innocence and alleged false implication. The State opposed the bail, citing the seriousness of the charges. The court examined the petitioners' antecedents, noting one clean record and one prior criminal case, and considered the nature of the allegations. Applying Section 438(2) of the Code of Criminal Procedure, 1973 and Section 482 of the B.N.S., the court allowed the anticipatory bail, directing release upon furnishing a bail bond of Rs. 10,000 with two sureties each, subject to conditions. The order was made for release within four weeks of any arrest or surrender before the lower court.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 438 CrPC in view of the alleged offences under the B.N.S.
  • Whether the petitioners pose a flight risk or threat to the investigation warranting denial of bail
  • Whether the prior criminal antecedent of one petitioner affects the grant of anticipatory bail
