Ajay SadaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The anticipatory bail application is allowed.

Summary

The petitioner, Ajay Sada, feared arrest in a case (Mahishi P.S. No.17 of 2025) alleging offences under the Bihar Narcotic Substances Act and the POCSO Act. The prosecution alleged that a person named Sadhu Sada abducted the informant’s daughter, while the petitioner asserted he was falsely implicated and that the victim’s statement indicated she was married to Sadhu Sada. The petitioner, who has a clean antecedent, applied for anticipatory bail, whereas the State opposed the relief. The court examined the submissions and noted the absence of any specific allegation against the petitioner. Relying on the provisions of Section 438(2) of the CrPC and Section 482 of the BNSS, the court allowed the anticipatory bail application. The petitioner was directed to surrender within four weeks and to furnish a bail bond of Rs 10,000 with two sureties.
