VIJAY YADUNANDAN YADAV @ VIJAY YADAV @ VIJAY KUMAR YADAVversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to a bond, sureties, and attendance conditions.

Summary

The petitioner, Vijay Yadav, was arrested on 31 October 2025 in connection with a case involving the illegal possession of a loaded pistol, live cartridges, and a fired shell, alleged under Sections 25(1‑b)a, 26 and 35 of the Arms Act. He applied for bail, claiming innocence and a clean criminal record. The court examined the facts, the length of his custody, and his alleged lack of antecedents. Considering these factors, the court allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to appear at the police station on the first Sunday of each month. The court also ordered verification of his antecedent before accepting the bail bond and clarified that the order is limited to the bail application and does not prejudice the trial.

Issues considered

  • Whether bail should be granted to the accused under Sections 25(1‑b)a, 26 and 35 of the Arms Act considering the nature of the offence and the period of custody.
  • Whether the petitioner’s claim of a clean antecedent warrants bail without further conditions.
