Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Bijay Sah, applied for regular bail under Sections 8 and 20(b)(ii)/(C) of the NDPS Act for an alleged offence of transporting ganja in the Dhamdaha police station case. The police had apprehended a co‑accused, Fakir Mandal, who named the petitioner as an associate; the petitioner was taken into custody on 24‑Nov‑2025. The petitioner’s counsel highlighted that he was not arrested at the spot, has a clean antecedent, and that other co‑accused have already been granted bail or anticipatory bail. The State opposed the bail on the seriousness of the drug offence. After considering the facts, the court ordered the petitioner’s release on bail with a bond of Rs 10,000 and two sureties, subject to his physical presence in court on all dates.

Issues considered

  • Whether the petitioner is entitled to regular bail under the NDPS Act for offences under Sections 8 and 20(b)(ii)/(C).
  • Whether the clean antecedent and the bail granted to co‑accused affect the bail decision.
