DISMISSED

Holding

The application for regular bail is dismissed.

Summary

The petitioners, Raja Ram Mehta and his son Prawesh Kumar Mehta, were arrested in connection with a case (PS Forbesganj Case No. 422/2024) alleging assault, murder and several other offences under the Indian Penal Code. They applied for regular bail, claiming they were falsely implicated, have no prior criminal record, have been in custody since 13 May 2025, and are willing to cooperate with the trial. The State opposed bail, arguing that the deceased’s body was recovered from the petitioners’ house, indicating their involvement. The Court examined the seriousness of the charges, especially murder, and the circumstances of the body’s recovery. Finding the offences grave and the evidence compelling, the Court declined to grant bail. Consequently, the bail application was dismissed.
